Kevin M. Daley is a co-founding partner of Daley Orton and an experienced trial attorney whose practice is focused on high-value personal injury and insurance bad-faith litigation. Over the course of his nearly thirty-year career, Kevin has earned a reputation for handling complex, high-stakes cases with thorough preparation, principled advocacy, and a willingness to take cases to trial when necessary.

Today, Kevin’s practice is concentrated on serious personal injury matters, including auto accidents, motorcycle accidents, truck and commercial vehicle accidents, construction accidents, slip and fall injuries, catastrophic injury, traumatic brain injury, and wrongful death. He also represents policyholders in insurance bad faith cases, including disputes involving denied, delayed, or underpaid claims where insurance companies fail to honor their obligations.

Kevin’s cases often involve life-altering injuries and significant losses. He regularly represents individuals and families facing permanent disability, brain injury, paralysis, or the loss of a loved one. In these matters, Kevin is known for his detailed case analysis, extensive investigation, and ability to break down complex facts—whether technical, medical, or financial—to develop a clear and effective litigation strategy.

Before founding Daley Orton, Kevin gained broad litigation experience representing a wide range of clients in state and federal courts, including complex civil disputes, insurance matters, and high-exposure liability cases. That background continues to inform his approach today, particularly in cases involving insurance coverage disputes and bad-faith conduct, where understanding how insurers evaluate, defend, and settle claims is critical.

Kevin appears regularly in both Rhode Island and Massachusetts courts and has tried more than a hundred cases to verdict. While many cases resolve through negotiation, Kevin prepares every matter as if it will be tried—an approach that strengthens his clients’ positions and ensures they are never pressured into unfair outcomes. Above all, Kevin is deeply committed to protecting his clients during some of the most difficult moments of their lives. He believes effective advocacy requires not only legal skill, but also clear communication, integrity, and a genuine understanding of what is at stake for each client and family he represents.

Insurance Bad Faith

Kevin represented a small business owner whose principal office was catastrophically damaged as a result of home heating oil being mistakenly dumped into its basement. Kevin's client made a claim under a Business Owners Policy that it had purchased, and the insurance carrier fraudulently denied the claim. A lawsuit was brought against the insurance carrier and after multiple years of litigation, recovery was made in the amount of $2,047,000 for the damages owed under the insurance contract and $10,000,000.00 for the insurance carriers’ bad faith, for a total recovery of Twelve Million Forty-Seven Thousand Dollars ($12,047,000.00).

Construction Accident

Kevin represented a construction worker who sustained serious injuries when he fell nearly sixty feet off a scaffold. His injuries included multiple broken bones and a mild/moderate head injury. The worker recovered from most of the physical injuries but he continued to be affected by the head injury, preventing him from working on a full-time basis. Shortly after the trial began, the defense agreed to settle the case for Three Million Two Hundred Fifty Thousand Dollars ($3,250,000.00).

Motorcycle Accident

Kevin represented the estate of a twenty-nine-year-old motorcyclist who was struck by a car at the top of a bridge. The motorcycle driver was catapulted off the bike and plunged over the bridge nearly 50 feet to his death. After three years of litigation, the case was settled for Three Million Dollars ($3,000,000.00).

Medical Negligence

Kevin represented an eighty-two-year-old woman who suffered a neurologic injury as a result of medical negligence. After two years of litigation, the defendant agreed to a settlement in the amount of Two Million Seven Hundred Fifty Thousand Dollars ($2,750,000.00).

Auto Accident

Kevin represented a 60-year-old man who suffered a serious back injury in an automobile accident. The insurance carrier for the party that caused the accident paid their policy limits in the amount of $250,000 and a claim was then brought against the injured parties’ own underinsured motorist policy. The insurance carrier wrongfully denied the claim, so Kevin filed suit in Federal Court, alleging that the insurance carrier engaged in bad faith by denying the claim. After several years of litigation, an additional $2,100,000 was recovered against the insurance carrier for their bad faith conduct, for a total recovery of Two Million Three Hundred Fifty Thousand Dollars ($2,350,000.00).

Kevin represented a 77-year-old man who sustained a serious leg fracture after falling out of a wheelchair. Shortly after the commencement of the trial, Kevin was able to secure a settlement for his client in the amount of Two Million Two Hundred Fifty Thousand Dollars ($2,250,000.00).

Kevin represented a man who was badly injured when a truck collided with him as he was driving his motorcycle on the highway. After several months of litigation, Kevin recovered the entire insurance policy limits in the amount of Two Million Dollars ($2,000,000.00).

Kevin represented a construction worker who sustained serious personal injury when he inhaled toxic fumes on a job site which caused injury to his lungs. Shortly before trial, Kevin was able to secure a settlement for his client in the amount of One Million Six Hundred Fifty Thousand dollars ($1,650,000.00).

Motorcycle Accident

Kevin represented a 45-year-old woman who was involved in a serious motorcycle accident. As a result of the accident, the woman sustained multiple broken bones as well as a vestibular injury. Shortly before the trial, the insurer for the individual who caused the accident settled for the policy limit of One Million Two Hundred and Fifty Thousand Dollars ($1,250,000.00).

Kevin represented two individuals whose home experienced mold contamination after water entered the same following a rain storm. The homeowners' insurance company did not properly remediate the mold and as a result, the house became uninhabitable. Kevin pursued a claim on the homeowners' behalf against their insurance company, and after several years of litigation, the claim was settled in the amount Nine Hundred Fifty Thousand Dollars ($950,000).

Kevin represented a 42-year-old man who sustained serious personal injury when he fell while trying to secure and transport a dumpster while working for a trash hauling company. The injuries (which included a fractured vertebra) caused him chronic pain on a permanent basis. Through Kevin’s diligence, the insurance companies paid the total policy limits available under two policies in the amount of Eight Hundred Thousand ($800,000.00).

Kevin represented a 50-year-old man whose arm was injured in a construction accident. The day before the commencement of the trial, the case settled for Seven Hundred and Seventy Five Thousand Dollars ($775,000.00).

Personal

Outside of the office, Kevin's principal focus is his four adult children (Kevin Jr., Brendan, Patrick, and Mia Grace). In the warm weather, the Daley’s take full advantage of Rhode Island's recreational resources by spending time at the Ocean States southern beaches and boating on Lower Narragansett Bay. In the winter, the Daley's enjoy Alpine Skiing in New Hampshire, Vermont, Colorado in Utah.
